Privacy Policy

Last updated: [date to be set at publication]

This website is operated to share information about home loan and mortgage broking services associated with Amit Kumar, an Authorised Credit Representative operating under Mortgage Australia Group. In this policy "we", "us" and "our" refer to that broking service. This policy explains what personal information we collect through the site, why, who we share it with, how long we keep it, and how you can reach us about it. We have kept it plain on purpose.

We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). We are based in Leppington, New South Wales, and serve clients across New South Wales.

What we collect through this site

We only collect what you choose to give us through the enquiry form on this site, or what you tell us when you call. We do not run accounts, logins, or hidden tracking on this website.

When you send an enquiry through the form, we collect:

  • your name
  • your email address and/or phone number
  • details of your loan enquiry (for example whether you are buying your first home, refinancing, or looking at an investment property, and anything you tell us about your situation or what you are trying to do)
  • anything else you write in the message or notes field

That is the whole list for the website. If you do not fill in the form, we do not collect personal information about you through this site.

Separate from the website. If you decide to go ahead and ask us to help arrange a home loan, we will collect more detailed financial information at that point (such as income, expenses, assets, debts and identification) so we can assess your needs and deal with lenders. That collection is part of the credit assistance process, is governed by the credit rules and the separate Credit Guide, and is not done through this website's form.

Why we collect it

We use the details you send through the site for one thing: to respond to you. That means replying to your enquiry, discussing your home loan options, and arranging a time to talk if you want to take things further. We do not use your details for marketing unless you ask us to, and we do not sell your information to anyone.

Who we share it with

To run the website's enquiry form we use Cloudflare Pages, the service that hosts this site. When you submit the form, Cloudflare receives the information you entered and passes it to our inbox so we can read and reply. Cloudflare acts as a processor on our behalf and may store and process the data on its infrastructure, which can be located outside Australia. You can read how Cloudflare handles data in its own privacy policy at cloudflare.com.

Beyond that, we share information from the website only:

  • with our own email provider, because that is where your enquiry lands so we can read it; and
  • if we are required to by law.

If you go on to ask us to arrange a loan, we will then also share the more detailed information you give us with the lenders and product providers you choose to apply to, and with Mortgage Australia Group as the holder of the credit licence we operate under. That sharing is explained in the separate Credit Guide before any credit assistance begins. We do not share your information with advertisers or data brokers.

Analytics and cookies

We do not run any third-party analytics on this site, and we do not use advertising or tracking cookies. Cloudflare, as our host, may set strictly necessary cookies needed to serve the site securely and to make the enquiry form work. These are not used to profile you or follow you across other websites. If we add analytics later, we will update this policy first and tell you what changes.

How long we keep it

We keep enquiry details only as long as we need them to respond to you and to meet our normal business and record-keeping obligations, then we remove them. If you become a client and we provide credit assistance, the law requires us to keep certain records for a set period; the Credit Guide covers that. If you would like us to delete an enquiry sooner, contact us and we will, unless the law requires us to keep it.

Your rights

Under the Australian Privacy Principles you can ask us to:

  • tell you what personal information we hold about you,
  • correct it if it is wrong, or
  • ask us to delete it.

To do any of these, or to ask a question about your privacy, contact us using the enquiry form on this site or by phone on 0433 031 309 (email: [contact email to be supplied]). We will respond within a reasonable time. If you are not happy with how we have handled your information, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

Keeping it safe

We take reasonable steps to protect the information you send us and to limit who can see it. No method of sending information over the internet is completely secure, so we cannot promise perfect security, but we treat your details with care.

Children

This site is about home loans and is meant for adults. We do not knowingly collect personal information from children. If you believe a child has sent us information through this site, contact us and we will remove it.

Changes to this policy

If our practices change, we will update this page and change the "last updated" date above. For anything significant, we will make the change clear.

Credit Guide / Important Information

Last updated: [date to be set at publication]

This is important information about the mortgage broking service shown on this site. It is a plain-English summary for the website. It is not the formal Credit Guide. A formal Credit Guide is given to you before any credit assistance is provided, as the law requires.

Who you are dealing with

Amit Kumar is a Mortgage Broker and an Authorised Credit Representative (Credit Representative number 570941). He provides credit assistance under the Australian Credit Licence held by Mortgage Australia Group (Australian Credit Licence number 377294). Amit holds a Certificate IV in Finance and Mortgage Broking.

Industry membership and dispute resolution

  • Member of the Finance Brokers Association of Australia (FBAA), membership number M-360392.
  • Member of the Australian Financial Complaints Authority (AFCA), membership number 116182. AFCA provides free, independent external dispute resolution. If you have a complaint we cannot resolve with you directly, you can refer it to AFCA at afca.org.au or by phone on 1800 931 678.
  • Professional Indemnity insurance is held to a level of up to $20,000,000.

What "general information only" means

The content on this website is general information only. It is not personal credit advice and does not take account of your objectives, financial situation or needs. Any figures, rates, repayments or savings shown anywhere on the site are illustrative examples, not offers of credit and not a guarantee of any approval, rate, saving or outcome. You should not act on anything here as if it were advice about your own situation. We are happy to give you advice tailored to you once we understand your circumstances.

How credit assistance actually works

If you choose to go ahead, we will:

  1. give you a formal Credit Guide that sets out our details, the lenders we work with, how we are paid, and your dispute-resolution rights;
  2. talk through your situation and what you are trying to do;
  3. assess what is suitable and propose options, giving you a Credit Quote and Credit Proposal where required before any work begins; and
  4. help you apply to the lender you choose.

We work with a panel of 40+ lenders including the major banks, with access to a wide range of home loan products. We are not owned by a bank and the choice of lender and product is always yours.

How we get paid

We want to be straight about this, because it is a fair question. In most cases our service costs you nothing directly for a standard home loan: the lender you choose pays us a commission once your loan settles. There is usually an upfront commission (a percentage of the loan amount) and an ongoing trail commission (a smaller amount each year the loan stays in place). Commission amounts differ between lenders, and we will tell you the actual amounts that apply to your loan in the Credit Guide and Credit Quote before you commit to anything. If a particular matter would involve a fee payable by you, we will tell you clearly and in writing before you agree to it. Being paid by the lender does not change our duty to find a loan that suits you; we explain how we manage that in the formal Credit Guide.

Acting in your best interests

By law (the Best Interests Duty that has applied to mortgage brokers since 1 January 2021) we must act in your best interests and put your interests ahead of our own when we provide credit assistance. That means our loan recommendations are based on what suits your situation, not on which lender pays us the most. The formal Credit Guide explains this duty and how we meet it.

Questions or complaints

For anything about this information, or to raise a concern, contact us using the enquiry form on this site or by phone on 0433 031 309 (email: [contact email to be supplied]). If we cannot sort it out together, you can contact AFCA (details above).
